A word to the wise: sell your car after it has been repaired because once even the most minor of repairs was done, insurance companies flat-out refuse to pay diminished value for a second loss on the car.

When I asked for the data used for my car I found out they were basing the value on a cab with tip (not sure how the VIN came out with that) in ”good” condition.

The repair does not need to have made it onto Carfax or Autocheck in order for you to qualify for making a third-party DV claim.

Coverage and how to read this overview
Counts describe captured discussions, not unique people or a diagnosis. Author identities are not reliably stored. Exact duplicate evidence is counted once across matching discussions; one discussion counts at most once per action/state. Multiple repairs reported together remain a combination. Suggestions and failed attempts do not establish a fix. Matches cover whole discussions and can include related faults, model variants and incomplete threads.

Basically the insurance company called me this afternoon with an offer of $4310.00 as a diminished value offer for the car, which is honestly more than I thought that they would offer. I was wanting 15% of the value of the car, and would have settled for 10% as my bottom figure. I would put the cars worth at 48k +/- a bit which would make my "bottom line" at $4800.00. I know that an insurance company is always going to low ball on the first round (imo), so my question to the group is:
Should I
a) take the money ala steve miller band style or,
b) argue for more by getting an independent appraiser evaluate the car and push towards that figure assuming it considerably more?
Thanks for the help to all!
After four months the car is all fixed, and you got new wheels and tires. Take the $4310 and drive the crap out of the car and enjoy it. Don't you want to be just done and over it? There you have my two cents....
Did you provide the insurance company with a third party appraisal at the outset? If so, what did that indicate as the diminishment of value?
Having been through this, if the car is fixed to your satisfaction, and you plan on keeping it, take the money. You can spend time, effort and money on more appraisals trying to fight for more from the insurance company, and you might get $1,000 more, less value of your time etc. In my case, my Cayenne was rear ended. The car was relatively new, so the impact on value given the car was new, was about $6,000. I had to pay about $500 for the third party appraisal, so net $5,500. Car was fixed to 98% satisfaction, I still have the car, but spent the $5,500 long ago....
Any prospective purchaser will have access to the video, before pictures, and the repair receipt.
you got at least 500 worth of tires, new rims, and a nice detail job. Take the money. By the time you sell the car it will be worth 25% less than it is worth today.
or, if you want to fight, go to a dealer to trade it in and ask how much they are knocking off with the car as it is.
when my 128i was rear ended last year i took the $600 check and bought Koni Sports. The scratch on the bumper got a friend a few months later and i am enjoying the stiffer ride. Spendthe money on something for the car you wouldn't have. That will increase the intrinsic value to you.
@GTorTT: This is a good point. I would say that the car was repaired to about the same 98% of my expectations, by a certified Porsche repair facility.
@ Tom R: You make some good points as well. Thanks!
Diminished value on the car. Basically when I go to sell the car it is worth less now that it has been in a wreck than if the car was never in a wreck even though it was repaired. It is tainted so to speak. The insurance company is obligated (in most cases) to compensate you for that diminished value. Prior to wreck the car was worth 48k-ish, now it is worth 42-ish (or less) due to the wreck.
As an appraiser in Canada, I say fight for another few weeks and get a lot more money. That is the way it usually works here. The insurance companies use messed up valuations to low ball people. Another idea is to just call the adjuster and tell him how great your car is and that you are going to fight and possibly sue unless he agrees to $X (where X is the number you are willing to accept plus a thousand or two) and then settle if they come close. BTW I am not familiar with your story or car.
Turbofan has a good point about valuation. The others are also right. But you do have to know what the appraisal was based on. For example, if the number you are quoted is based on KBB low-end of the private party spectrum, there is a lot of room to move up. You won’t be wasting any time by presenting a counter justified by your upgrades and car’s previous condition. When I asked for the data used for my car I found out they were basing the value on a cab with tip (not sure how the VIN came out with that) in ”good” condition. My car was a coupe 6sp, so I knew the proposed money was actually starting out in my favor. But I still pointed out some recent upgrades I did and had photos of the pre-existing condition that boosted my settlement by nearly $2k by doing 15 minutes of due diligence. In any case, good luck and I’m glad you have the beast back on the road.
hatcheff15 makes a good point, if you feel like spending a little time just go through some sold car listings from your year and relative same mileage, and i'll bet you'll find the difference is more like 6-8 k for what an accident reported car sells for. I doubt they can, or will, argue with you if you provide them with a few examples, as they know they'll lose in an arbitration. Close to 90% of the people I know will not buy a car with an accident, as they dont want the same hassle when they have to sell. Myself included.
Fight for more. Im preparing to go through this process as well. Youre in ATL, right? Im using a gentleman recommended by the local Porsche certified shop. His guarantee is to get his customers at least $500 above whatever the insurance companys initial DV claim is. If he cant, he refunds his flat rate of $295. Seems like a worthwhile proposition to me.
The insurance companies are freaking leaches and they live for people who dont fight for what they are due.
Good luck! Would you be so kind to post some pictures before and after? This story is very interesting. Seems like a lot of threads lately with people getting hit in their cars.
Also, could you please fix Atlanta traffic?
Getting from the airport via I-85 through I-75 is the worst!
Before and after of the car? Those are in the link in the first post. Can help with the traffic sadly, best thing to do is always MARTA into the airport.
To put this one to bed. They offered 4310, I got the appraisal done and they called it at 6600 and we met in the middle at 5500. Word to the wise, get the appraisal done and dont leave money on the table. It was quick, easy, and I have 1200 more than if I would have taken the initial offer.
I recently went through this. I got nearly $1900 more than insurances Initial offer. But I did have to threaten litigation to get them there. The current insurance system is all a scam; one that we all are forced to support.
My Allstate agent is actually pretty good, that is, for an insurance salesman.
I don't know how to start the DV process, I just got my car back from repair.
Is it too soon?
I want to sound and appear that I know what I am talking about, so I need to learn as much as I can.
I don't want to bring in an appraiser if I don't have to, but I want to be foolish either.
Fwiw, my appraiser has been great to deal with but he totally plays the game that hes (likely) instructed to.
All you you do is tell them that youd like to make a claim for diminished value. They will then low ball you and tell you to pound sand if you ask for more. Youll then pay $300+ to hire an appraiser to create a more realistic value for you. Then your insurance will magically be more willing to hire their own appraiser who will then come back with a value less than what your appraiser produced. Youll then ask them to split the difference between the two quotes. They will either accept or tell you to pound sand. Youll then have your appraiser draft a more threatening letter to send to their legal team basically threatening to take them to small claims court. Theyll either relent or again tell you to pound sand.
Wash. Rinse. Repeat. Its all a game and all a scam.
pretty much this. you ask for a dmv claim, they offer you X, you pay 200-300 for an appraisal and they come up with Y, and then you meet in the middle-ish.
No form. Just email your claims rep and tell them you want DV. A claim through insurance is what goes on your record. The point of the DV is to get financial recuperation due to the ill effects of said claim on the cars record.
Sure. If there was no structural damage or air bag deployment then the car has only lost a maximum of 15% of its pre-accident trade-in value. So, if you had called St. Lucie Appraisal and told us what the settlement offer was we'd advise you to forgo the appraisal cost and take the money. It may be possible to wring a few more dollars out of the insurance company but it seems, as unlikely as it sounds, that you've been treated fairly and adequately compensated.
WARNING!!!!
For all vehicle owners driving previously repaired cars. If you've heard that collecting a fair settlement amount for the diminished value of your car after accident repairs is a difficult process, you will have a much more difficult, if not virtually impossible task of collecting ANYTHING AT ALL should your car be hit again.
A word to the wise: sell your car after it has been repaired because once even the most minor of repairs was done, insurance companies flat-out refuse to pay diminished value for a second loss on the car.
The repair does not need to have made it onto Carfax or Autocheck in order for you to qualify for making a third-party DV claim. If an insurance company denies your claim for this reason simply ask them if they are suggesting that you sell or trade in the car without disclosing the wreck? There is a 100% chance they will say "no" which makes your case.
Ask your insurance broker whether they offer an endorsement that would protect you from any diminished value claims in losses you have caused. I find it helpful when renting cars because without accepting their coverages you can be socked for thousands if you cause damage to someone else's car.
