Coverage and how to read this overview

Counts describe captured discussions, not unique people or a diagnosis. Author identities are not reliably stored. Exact duplicate evidence is counted once across matching discussions; one discussion counts at most once per action/state. Multiple repairs reported together remain a combination. Suggestions and failed attempts do not establish a fix. Matches cover whole discussions and can include related faults, model variants and incomplete threads.

POST 1 / ORIGINAL POSTEROriginal post

Folks, quick question. In CA, isn't the seller responsible for the smog when buying a used car? So if you're buying a used car from a dealer, who's responsible for the smog fee? You or the dealer? I just took a quick look at a contract that was sent to me and there's a line item for smog. I thought it was the seller's responsibility...

POST 2Original post

dmv says its the seller. in practice, that isnt always the case. when buying used from dealer, buyer always pay. factor that into your negotiation. remember, u r the customer

POST 3Original post

Are you keeping the car in the state or taking it out of state? I don't think you have to pay the smog fee if the car is immediately taken out of state and not titled in CA. That's the way it used to be anyway...

POST 4Original post

Seller... DMV site says so. I bought a 944 T that "should pass no problem, man". It was a problem... man.

POST 6 / ORIGINAL POSTEROriginal post

Hmm, the car will be in state in CA. I know for private party sales, it's the seller's responsibility. I was not aware that from a dealership is different as referenced by djantlive. I'm actually kind of annoyed now. We agreed on the price, and I told them I didn't want to deal with any BS "fees" for this and that. It was price of the car, plus tax and DMV license fees. They apparently put on some "s/n etch" that's invisible to the naked eye on parts of the car since it's a "highline" car. Charging $289 for it. I told them I don't want it. But they did it already on the car. Now I see a line item for smog. Document fee $80 Emissions Testing charge $37.25 Code Protection $289.00 Actually, now that I look at this "sales contract" that was sent to me, the line item for emissions testing reads like this: Emissions Testing Charge (not a government fee) $37.25 WTF!

POST 7Original post

I believe that while the seller is responsible for the car passing smog, it can still charge for the testing/certification. What it can't charge for is the cost of bringing the car into emissions compliance. Sincerely, Macster.

POST 8Original post

37 is very reasonable. You should not pay for that etching since you didnt approve it. I would threaten not to buy the car to have the charge removed. They should absorb their own mistake.

POST 9Original post

Quotes source post: 9735235

No problem. Just pay them with invisible dollars.

POST 10Original post

really? I cant believe they actually have a law about it. I would think it would be negotiable.

POST 11Original post

Quotes source post: 9734888

I love this... man "no problem.... man" will get you everytime

POST 12Original post

I would thank them for the etching and decline to pay for it since you did not request nor authorize it to be done.

POST 13Original post

I don't think the fee is mandated either way. It is just that the seller is responsible for making sure it passes. The fee is negotiable.

Thanks for the link. But if you read the message/thread you would realize I was talking about buying from a dealer and not an individual person.

I would think a "seller" is a "seller" regardless of private party or dealer but I can google that too if you want!? J/K Sorry for not reading more carefully and/or offending you.
