Dont know how it is in your state, but in Florida, I go to court and speak to the officer, and check his paperwork to see if he has his laser/radar certificate in order, if so, then I ask the officer if he would object to me asking the judge to withhold the points.

Based on information I have obtained from NHTSA, the National Highway Traffic Safety Administration, a citation based on the use of moving RADAR for speed measurement is not to be considered enforceable absent a valid tracking history.

Whereupon Officer Cook immediately responded that he was also trained to use other means, road signs and markers, to correctly judge my oncoming road speed.

Coverage and how to read this overview

Counts describe captured discussions, not unique people or a diagnosis. Author identities are not reliably stored. Exact duplicate evidence is counted once across matching discussions; one discussion counts at most once per action/state. Multiple repairs reported together remain a combination. Suggestions and failed attempts do not establish a fix. Matches cover whole discussions and can include related faults, model variants and incomplete threads.

Moving traffic radar speeding citation at mile marker 144 Westbound on I-10 just east of Van Horn TX. Officer, Eastbound, said he clocked me at 88 in a 75. Absolutely certain he was wrong, but.....

POST 3Original post

Plea bargain to a higher paying violation that will not effect your driving points and insurance.

POST 4Original post

Does that work? If so, I'll file that for future!!!!

POST 5Original post

In the past speeding experiences (3 total), I managed to speak to prosecutor prior to the assigned court date stated on the citation. I informed them of the situation (dont want my record or insurance effected) and was informed of my options. You will have to plead guilty to a different charge but no harm done, only to your wallet. One of the charges I pleaded to was something along the lines of disregarding a posted sign, where in actuality I did disregard the posted speed limit. Most municipalities have such citations that bring in revenue to their city, they are more costly but your driving record and insurance will not be affected. Think of it as a win/win situation. or if your kind enough to the state toppers....you can bs your way out of it and have them pose with you.....LOL

POST 6Original post

Alright Alex. What line of BS did you pull that not only got you out of ticket but got the officer to pose with you and the car?

POST 8Original post

pay your fine and take your lumps. in CA you can plea bargain for 'secret' traffic school even if you been within 18-mos and you'll save point on your record. i was pinched for 107 on a fwy off-ramp last yr and they threw the book at me... to fight an 88 in a 75 (paced or radar) the judge will not buy your story.

POST 9Original post

Frankly, @107 on an offramp, you deseved the ticket!!!

POST 10Original post

3:30 am, no trafic on a 10-lane fwy, it was stupid but not necessaily unsafe. in hindsight i should have hired a lawyer, but with 2-pts now on my record, my insurance has not risen appreciably.

POST 11Original post

Great pic Alex...you both look happy so i guess thats good!

POST 12Original post

If anyone has ever attended Limerock, you know how great the roads in CT can be. So full day at the races watching Porsches kick butt at Lemans...I was full of adrenalin and should have relaxed afterwards but the roads were calling my name. I was following an old vette (69 I think) and decided to pass him on a turn. Sure enough, as soon as I passed him doing about 80, a state trooper pulls out. Lights come on and I pull over..#$$%$ He approaches me with his hands on the triggerI am thinking to myself what the $&%@^ did I get myself into this time, I roll down my tinted windows and he comes over and asksin a hurry? I said sorry officer for speeding I know I wasjust left Limerock and do not know my way around here. I was just was honest with him and sure enough the conversation changed to Lemans and my carended up getting out of my car letting him drive it, snap some pictures and even a video of me getting arrested and thrown in the back of his vehicle...he was cool.

13:30 Oct 4, 2005....CASE DISMISSED!

POST 16Original post

Hire an attorney. I am an attorney and one of my areas of practice is traffic violations. Dont know how it is in your state, but in Florida, I go to court and speak to the officer, and check his paperwork to see if he has his laser/radar certificate in order, if so, then I ask the officer if he would object to me asking the judge to withhold the points. Most officers dont object, unless the person who got the ticket gave them a real hard time and was rude, even if he objects, I get the judge to withhold the points, unless the client's driving record is horrible. If the officer's paperwork is not in order then I ask for a dismissal. Also, sometimes the officers don't show up for court...too busy, too lazy, whatever the case may be, then ticket gets dismissed. I think it would be wise to hire a traffic attorney, he could most likely get the points with held which will help with the cost of insurance in the long run. Also, you can also have a trial on the case, but if the officer has all his ducks in a row, the judge most likely will side with the officer, as there is no jury to convince in the traffic cases.....unless its a DUI. Or you can take the driving school. I think they even have the tapes at blockbuster now to make it real easy, if thats an option in your state. Just my two cents. Good luck. Lou

POST 20 / ORIGINAL POSTEROriginal post

JUSTICE COURT PRECINCT 1 CULBERSON COUNTY 105 WEST BROADWAY P.O. BOX 367 VAN HORN, TEXAS 79855 REFERENCE: DOCKET NUMBER 05-55242 CITATION NUMBER 128344 MOTION TO DISMISS I hereby respectfully request that the citation and any and all charges, fees and fines in this matter be dismissed by the court for the following reasons. Officer Cooks statements to me at the scene indicate that more likely than otherwise his visual observation of my speed, tracking history, for purposes of validating the moving radar indication, was mistaken. Based on information I have obtained from NHTSA, the National Highway Traffic Safety Administration, a citation based on the use of moving RADAR for speed measurement is not to be considered enforceable absent a valid tracking history. I content that Officer Cooks visual judgment of my speed, tracking history, was not only too brief (***) to be considered a valid tracking history but was also more likely than otherwise to have been mistaken. *** Assuming I was traveling just below 75 MPH as was Officer Cook our closing velocity would have been approximately 200 feet/second. Officer Cook stated to me at the scene that as I came around the curve toward him I was passing everything in sight and he judged my speed to be 86 MPH.. I immediately informed Officer Cook that Yes, I was passing everything in sight because all of us had just departed the rest area and I was in the left lane accelerating more rapidly that the other three cars. Whereupon Officer Cook immediately responded that he was also trained to use other means, road signs and markers, to correctly judge my oncoming road speed. This latter statement by Officer Cook is quite clearly of a defensive nature. This statement by Officer Cook makes it sound as if he had been unaware of the speed of our oncoming group relative to stationary objects until I pointed it out to him. But the statement he made to me after I said that I would be contesting the citation is even more telling of Officer Cooks overall frame of mind. Officer Cook said: Why would you contest the citation since you already admitted that you over-speeded your engine? It is incomprehensible to me that a traffic enforcement officer with a reasonable level of training and experience would take my statement that I had over-speeded my engine as an admission that I had driven above the posted speed limit. As a result of my conversation with Officer Cook at the scene prior to his writing the citation wherein I admitted that I had over-speeded my engine I firmly believe Officer Cook mistakenly took my that statement as an admission of the validity of the moving radar indication. In the alternative since I could not truthfully state at that time that I had not gone over the speed limit Officer Cook decided to write the citation on the assumption that I would not be able to contest it. Summary: Officer Cooks unquestioned skill at judging vehicular speed was compromised by facts of which he was not aware, could not have been aware, the fact that the group of four cars he observed were all in the process of accelerating up to highway cruising speed having all just departed the rest area.
