[I *should* have had 2 checks cut- one to the bank for the car, and one to the PO for the difference.] We had even talked to the bank in advance so they could move the title to this branch and do everything that day, but they don't do that- they have some stupid-*** 10 business day waiting period (which they didn't even start counting until they cashed my cashier's check several days after I signed), then SNAIL-MAILED the title to the PO, who signed it and fedexed it to me.

Coverage and how to read this overview

Counts describe captured discussions, not unique people or a diagnosis. Author identities are not reliably stored. Exact duplicate evidence is counted once across matching discussions; one discussion counts at most once per action/state. Multiple repairs reported together remain a combination. Suggestions and failed attempts do not establish a fix. Matches cover whole discussions and can include related faults, model variants and incomplete threads.

POST 1 / ORIGINAL POSTEROriginal post

I'm buying a third car (I'm keeping the C4S and V8 M3). It's not a p-car but a 420hp winter "beater'. It's a private sale in PA (I'm in NJ) and the car is financed so the owner doesn't have the title. He is buying something new from a new car dealer and wants to sell me his car and have the dealer do a courtesy trade for sale tax purposes. If I buy his car at the agreed upon price through the dealer, I will have to wait for his finance company to release the title. I believe I can't register the car in NJ until I have possession of the title. I will be buying the car with case (certified check) so the title should be sent directly to me. Any advice, has anyone done this senario before? I've bought about 20 cars, some out of state and I always pay cash so I always get the title when I give the check. thanks Glenn

POST 2Original post

Have the dealer hold the car until the clean title is procured, then do the check/title exchange? Maybe give them a small down payment to hold the car?

POST 3Original post

Correct, You will need the title to register. If the dealer is doing a courtesy trade than are you not buying the car from the dealer? They should be able to pay off the loan and flip the title and provide you temp tags in the interim and ya gotta tell us what you are buying!

POST 4Original post

not having a title when selling a car can be a bit of a pain (ask me how I know) When I sold the 99' I didnt have the title, and the 86' was free and clear. We wanted to "gift" each other our cars in order to not have to pay taxes since we were just doing a swap....wanna know how cool Mike is.... He gave me $15k (my pay off was more like $19k ) to buy my car from the bank. I then got a new loan for the $15k and gave him that to "buy" the 86'. so my bank had the title to the 86' and released the 99' to me. after about 5 weeks I got the title in the mail and met him at the DMV where I "gifted" him the car and for $25 we transfered title. how is that for a good guy! I know its not typical, but there are indeed very trusting and honest people still left in this world despite what the TV tells us everyday !! my point it where there is a will, there is a way - I am sure some solution will present itself, just make sure its rock solid and you are protected since there are more parties involved than just you two...

yes I can get temp tags but I believe I can't title the car (basically can't drive it) until his title comes from the bank which will take weeks.

POST 9Original post

My Boxster S sat tagless in my garage for a month until the PO's bank finally released the title. It's frustrating, but that's part of buying a new car from a private owner, just like reliance on trust from both parties. Still a ton cheaper than buying from a dealer. The specific procedure depends on the back. In my case, we met in the bank parking lot to sign the paperwork. I cut a check to the PO, who deposited it and cut a check to pay off the car, which was done right there. The fexex came at about 10am 30 days after I'd "bought" the car; my wife drove it to me at work, and I took it directly to the DMV and got my temp tags. Was a royal PITA.

POST 10 / ORIGINAL POSTEROriginal post

I've sold at leaset 10 cars private. I always pay off any financing before I sell so I have the title in hand. Very easy to sell privately that way. But anyway..... Buyer is telling me that his bank said that Pennsylvania puts all the titles on line. is this true? I believe what sjfehr is saying, I'm sure it will take a while to get the title. I have a deposit on another SRT-8 at a dealer and I was supposed to take delivery today, then this potential private sale came up yesterday and its a better deal but if it falls through, i don't want to lose the deal I have at the dealer since that one I know is mint.

POST 11Original post

Yes, you need a title to register. Even though its "online" you still need a physical title to show NJ. That means, the bank that holds the loan will not release title untill they are paid off. Its not clear to me why you cant simply buy the car from your friend? who's paying sales tax here? the seller? no.. the buyer.. when the buyer registers the car. I don't think when you sell a car you pay a sales tax, but who knows anymore. Is it your buddy who's looking to save some money by trading in his car? if the bank that holds the title is "local", you could pay it off directly and have them release the title to you. Yes, it still may take a couple of days, but otherwise you are left "trusting" a lot of people.

It's not a friend, its someone I've emailed on one of the Jeep Forums. I would like to buy from him directly (his bank has the title since its financed). He wants to run it through the dealer who he's buying a new car from. His new car dealer did not give him what he wanted on the SRT-8 trade in and told him to sell it privately to someone else and he will run that sale through his dealer. This way he can use that sale as a trade in on the new car to save on sale tax. For example and I'm just making up numbers, if he was buying a new car for $60k and selling the old one for $40k, he only has to pay sales tax on the $20k difference instead of selling on his own and paying sales tax on the new car of $60k. I bought several cars out of state but the private sellers always had the title in hand and I would pay certified funds so I would receive the title and register when I got back to jersey. I think one time I bought a financed car from someone and I drove out to their bank, paid of their lien and the bank gave me the title right there. I don't think his bank is local.

POST 13Original post

He's trying to save tax.. but you are offering him MORE than the dealer would give him. I don't think HIS potential tax burden should be your problem. I don't get the tax issue overall I guess. I don't see how he's taxed any less in a "trade" than if he walked in with 40K in cash (per your example) vs having a car to trade in.

POST 14Original post

If you get temp tags you won't need the title until you register it in NJ(I'm not sure that you can get temp tags without the title either). Drive it on the temp tags until you get the title.

RaceCarDriver: The seller may be saving a little on sales tax through this arrangement. But won't you have to pay a dealer fee buying through the dealer? Did you have an agreement to waive the dealer fee?
