My guess here is the person-at-fault (PAF) will stiff you at some point, and probably already has, given the PAF wants to avoid both an accident claim against his auto insurance, and a future outlay of any repair monies for your car.

Coverage and how to read this overview

Counts describe captured discussions, not unique people or a diagnosis. Author identities are not reliably stored. Exact duplicate evidence is counted once across matching discussions; one discussion counts at most once per action/state. Multiple repairs reported together remain a combination. Suggestions and failed attempts do not establish a fix. Matches cover whole discussions and can include related faults, model variants and incomplete threads.

9 eligible posts · 0 unverified posts · 1 discussions match the subject in their title or opening post.

POST 1 / ORIGINAL POSTEROriginal post

IMG_7645.jpeg (5 MiB) Viewed 1238 times So this happened last Wednesday. The person who did it backed into me. He admitted it and gave me his insurance. The car is a 2009 all original including paint and it was immaculate and was always getting comments on how beautiful it was and how desirable it was for all original paint how exceptionally good it is. The guy said he would prefer to pay cash rather than go through his insurance. The repair estimate was only $3300.00 as the shop is only charging me $60 an hour for the labor and he is balking about it asking me to get other estimates. Personally I think that takes a huge set of cajoles to do. I was calm about it from the start and nice. Now I am not feeling so nice about it. I will get it fixed one way or another I have just as big a concern about the value impact. I am curious if anyone knows how much having to replace a whole panel and get matching paint work will devalue the car?

POST 2Original post

That's too bad. Always a pain! It's not so much the dollars difference, but more so it's marketability. People will always be hesitant when they see the car has been in an accident of course. Saying that, I would speak with your insurance company and ask them [or appraiser] about compensation for diminished value as part of it. That should compensate you for any loss you'll take on the other end. If you don't go through insurance, just be careful. You might be able to get more money, since they guy probably will be ok paying a premium if it means his insurance does not have to go up. Quote from body shop + diminished Future value Also, once it's painted. Make sure you look at it in different lights before driving away. Depending on the body shop, they sometimes are not the greatest at color matching.

POST 3Original post

I think your reply should be "Sir, you asked me to get more estimates and I asked a few friends for their advice. They told me to only go to a Porsche repair center, and they told me to inquire about diminished value, and they told me not to forget a rental car while mine is being repaired." Maybe next time he won't balk at a single estimate.

POST 4Original post

Gbro, I'm curious about how this turned out for you. Any updates? Thanks.

POST 5Original post

Gbro, In part your original post read: “The repair estimate was only $3300.00 as the shop is only charging me $60 an hour for the labor and he is balking about it asking me to get other estimates.” You did not say whether or not the accident was either in a parking lot on private property (“parking lot”), or on public property as a street or city lot. Usually state law requires a filing of an accident report with its Motor Vehicle agency, with damage over a certain amount (some as low as $200) by a driver involved in a property damage vehicle accident. The filing period may be as short as ten (10) days. If you make a claim against your insurance (one poster suggested a diminution of value claim (also known as "diminished value" – more on that below), you should get the Accident Report form on-line from your state’s Motor Vehicle agency. Be ready to file it on the advice of your insurance agent or company representative company when you notify your agent or insurance representative of the “parking lot” accident. Of course CarFax (or a like company) is going to pick up that filing with the state Motor Vehicle agency (public record), but your Porsche only appears to be damaged on its rear bumper surround. Just document the repair and when you part with the car, be prepared to show the photos and the repair documents to the buyer. Any serious buyer will appreciate you being candid. Immediate Action. My guess here is the person-at-fault (PAF) will stiff you at some point, and probably already has, given the PAF wants to avoid both an accident claim against his auto insurance, and a future outlay of any repair monies for your car. You gave the PAF a chance to step up at a measly $3,300. The PAF did not take that opportunity. It is time to move on. Inform the PAF, if you care to, that you are contacting your insurance company to have the repairs done on your collision insurance, and that you will give your company a full written report with his insurance information. Your insurance company will authorize the repair (after your insurance company has confirmed the damage, perhaps even sending an estimator to look at your vehicle at your home or chosen repair shop). Again, move on, and let your insurance company deal with the PAF’s insurance company. Diminution of Value (also known as "diminished value") from an Property Damage Accident. As a lay person I have learned auto insurance companies will go to some lengths to avoid paying such damages. Some states are fair minded (Georgia comes to mind) and have insurance law in place that permits an insured to make a claim against the insured’s own auto insurance. Other states have a different statutory scheme, and a claimant may only proceed against the other party and his auto insurance for any claim of diminution of value as to a damaged vehicle. Either talk to the family lawyer, or “Google” your “state” and “vehicle diminution of value” or "vehicle diminished value" (or some variant phrase) to learn what your status may be. From personal experience, a claim of diminution of value takes commitment and time by an owner. Generally you have to retain an expert (witness) to make a written estimate of diminution of value resulting from the accident and the repairs to your vehicle. This may not be true if your state permits a claim of diminution against your own auto insurance. Good luck in any case!

Still waiting for my repair shop to engage Allstate. they are booked till after th first. The person at the shop who did the estimate was with Allstate for 14 years and does not have a very good opinion of them. He knows how to work it. If I need to I will put through my shop or pay cash and deal with it after the fact. for the record I was once an attorney, not very good and only last two years before I could no longer stand being a part of the industry. So I am able to handle the lega ins and outs unless we go deep then I will have one of my attorneys handle that. Thanks to all for the input and all of you mirror my own thoughts about it. Type 1 thanks for the level of analysis and comment. Appreciate you all and will update once we get things done with pictures. the shop I used matched my Getty DuckTail exactly and the praise for their work on that has been overwhelming. I know they will nail it.
